Shopozz.ru Service Agreement

SHOPOZZ CORP, the resident of the United States of America (hereinafter - "Responsible party") and capable full age individual who is registered on Shopozz.ru site (hereinafter - " Customer "), complete the following agreement:

  1. Acceptance
    1. The Acceptance in the present Offer is the registration of the Customer on the Site of the Responsible party.
    2. On the date of accomplishing the Acceptance by the Customer, the Customer and Responsible party are considered to sign the Agreement for Distribute.
    3. In order to avoid any sort of misunderstanding, having accomplished the Acceptance, the Customer confirms that:
      He is entirely acquainted with conditions of the present Offer;
      He signs the Agreement for Distribute only for personal, family or other needs not connected to business operations, and such needs is in agreement with the applicable Legislation.
    4. The client agrees that Responsible party uses and processes personal information of the Customer.
    5. The client agrees that after registration on the Site Responsible party sends letters and messages, including advertising at Customer e-mail address and specified mobile number. Responsible Party is obliged not to transfer the address and other information about the Customer to third parties.
    6. The Customer may at any time require the removal of personal information by contacting our Customer Support Service and sending a letter with a request to the address ask@shopozz.ru
  2. General Provisions
    1. Responsiple party provides mediatory services for the purchase of commodities in online-shops and at United States auctions - hereinafter "Service", in compliance with this agreement.
    2. Responsible Party reserves the right to insert amendments in this Agreement, wherefore the Customer is obliged to monitor amendments in the Agreement, available at https://shopozz.ru/agreement.
    3. The Customer agrees to the terms of the Agreement when contributing money to a personal account on the Shopozz.ru site and / or by clicking "Add to my orders" in your account.
    4. For the Service Responsible Party holds a commission from the Customer specified in the "Services" section.
  3. Service order
    1. When you add products to your Personal Account, Customer is obliged to point an overall cost of commodities, cost of commodity delivery to a warehouse of the Representative Party on the territory of the USA, and also the sum of levy tax from sales, or other types of taxes operating in the country of making purchase. In case the Customer didn't specify necessary information or specified it incorrectly, the Responsible Party has the right to remove from the User Customer Account the sum necessary for a covering of expenses, no more than 30% from commodity cost (group of commodities), when purchasing commodities specified by the Customer. With a shortage of funds for full commodity payment the product can be purchased with the formation of the debt on the User account. In case within 12 days this debt isn't extinguished by the Customer, the commodity comes back to the Seller and Customer has the commission for the Representative Party services: cost for delivery to a warehouse of the Representative Party and cost for return delivery from the warehouse of the Representative Party to the Seller warehouse.
    2. At the indication of sizes (for clothes, footwear, etc.) it is needed o specify American sizes or to specify near UK, EU, Ital, etc the size . Otherwise the Responsible Party considers that the specified size is American, and purchase the American one.
    3. The client accounts for compliance of acquired commodity to delivery terms of post service and to the customs code of the country in which including but not limited to size, weight and content of the product, including size and weight of the postal packaging required for delivery of commodity to Customer by the Postal Service.
    4. In the case of participation in the auction the Customer is obliged to transfer necessary amount of money to a personal account in advance. In case of a shortage of funds of the Personal Customer Account , further increase of rates is not possible.
    5. The Representative Party undertakes to pay the commodity specified by the Customer , on its own behalf, but at the customer account expense on condition that commodity delivery is on the territory of the USA.
    6. In case of lack of the ordered Commoditiy at the Seller warehouse, the Representative Party has the right to cancel the specified Commodity from the Customer Order and inform Customer sending the electronic message to the address specified during the registration (or the message in the section "My Messages").
    7. The Representative Party undertakes to accept Commodity which was delivered by post service of the Seller to the warehouse. Term of free storage for the Commodity of the Customer in a warehouse takes 1 month from the moment of receiving it to a warehouse. Term of free storage for the packed parcel of the Customer in a warehouse takes 7 days. For the storage of Commodity and/or Parcels of the Customer over a free period of storage the Representative Parsel raises the commission for storage. Term of free storage is when the Commodity physical arrivals to the warehouse of the Representative Party. In case of absence of Commodity demand by the Customer within 90 days from the date of receiving at the warehouse, the Representative Party has the right to utilize Commodity.
    8. In case the Seller didn't send Commodity, the Representative Party tries to return the paid money, but doesn't guarantee its return and in this case doesn't compensate loss of the Customer. The Seller is chosen by the Customer and the Representative Party doesn't bear responsibility for his actions.
    9. In case of refusal from Commodity, which are paid for the Seller (including Commodity which was redeemed with formation of debt at the User Customer Account), the cost of the return delivery of commodity from the Customer to the Seller is taken and the commission for the Representative Party doesn't tur back. Refusal of purchase from the Ebay.com auction is impossible if the Seller doesn't specify the rules of returning in the description of an item. If the rules for Commodity return are specified, return is possible only according to these rules.
    10. The Representative Party undertakes to pack the Customer Commodity received at the warehouse according to data which the Customer specified in the section "My Orders — Parcels" of his profile. In case the parcel of the Customer according to its the weight or dimensions can't be sent by the way of delivery which was specified by the Customer, the Representative Party has the right to change the way of delivery of a parcel.
    11. The Representative Party reserves the right to change rates and service conditions on a unilateral basis, notifying Customer by placing of changes at the Shopozz.ru site.
    12. The Representative Party reserves the right to refuse to the Customer acquisition of any Commodity without without assigning any reasons.
  4. Replenishment of User Customer Account
    1. Replenishment of User Account is possible by the ways specified in the section "Payment".
    2. In case of the incorrect indication of the Commodity price ordered by the Customer, the Representative Party informs the Customer about it as soon as possible for confirmation or cancellation of the ordered Commodity. Where impossibile to contact the Customer this order for purchase of Commodity is considered to be cancelled.
    3. The Representative Party doesn't credit Customers, and doesn't redeem Commodity by credit (except cases of paragraph 1, part 2 hereof ), and doesn't send the Parcel on credit.
    4. At payment to the account of our company, the Customer is obliged to pay the bank commission of intermediaries.
    5. If delivery across the USA is free for a certain sum of the ordered commodities, but subsequently from this paid group of commodities is removed even one commodity(for example, because of its absence) which will lower the sum below threshold amount, delivery becomes paid and money is taken from the User Customer Account.
  5. Formation of the Parcel and Delivery of Commodities
    1. Delivery of commodities is carried out in the ways and at the rates specified in the section "Delivery" and "Services" of Shopozz.ru site.
    2. Payment of Commodity delivery for the Customer is made separately from payment commodity. The cost of Commodity delivery for the Customer is specified after the parcel is packed and weighed. After parcel packing the Representative Party doesn't open the packed parcels and doesn't change Commodity. In case of shortage of money on the customer account, transfer of a parcel to a delivery service will be detained untill the Customer pays off a debt of the Personal Account.
    3. The Customer can insure a parcel, having specified the insured sum at parcel registration. The insurance premium is removed from the User Customer Account. In case of parcel loss, the Representative Party submits the application to post service on compensation of the insured sum. In case of compensation, the Representative Party charges the insured amount to the Customer Account.
    4. The Representative Party undertakes to send the packed parcel with the Customr Commodity to post service which the Customer specified in the section "Parcels" of his profile page.
    5. Services are considered to be completely rendered by the Representative Party from the moment of transfer of the Customer Commodity to post service.
    6. The Representative Party gives opportunity to the Customer to fill the Invoice which will be enclosed in a parcel independently.
    7. The Representative Party isn't responsible for actions of post service, courier services and transport companies and can't influence delivery speed. The delivery periods specified at Shopozz.ru site are approximate.
  6. Representative Party Service
    1. The Representative Party undertakes to provide the Customer with Service, and also to fulfill the requirements of the Customer binded with performance of these services if requirements don't contradict to this agreement, information specified on Shopozz.ru, and also the current legislation of the Russian Federation.
    2. The Representative Party undertakes to keep confidentiality of the information provided by the Customer and not to disclose it to the third parties if it isn't required for performance of conditions of this agreement.
    3. To provide the Customer with information of performance of the instructions specified in this agreement.
  7. Customer Service
    1. The Customer undertakes to provide in due time full reliable information necessary for rendering Services by the Representative Party. In case of a lack of such information or doubts in its reliability the Representative Party has the right to suspend rendering Services.
    2. The Customer undertakes to pay in due time and the full cost of the ordered Commodities, cost of their delivery to the warehouse of the Representative Party, taxes and other expenses arising in connection with rendering Services by Representative Party, and also cost of a commission of the Representative Party, cost of Commodity delivery to the Customer. In case of shortage of correncies the Representative Party has the right to suspend or stop service of the Customer.
    3. The Customer undertakes to store all documents confirming fee of the Representative Party, before transfer of money to the Personal Customer Account.
    4. The Customer undertakes not to use the ordered Commodities in the entrepreneurial activities.
  8. Terms of return and exchange
    1. In case of a return/exchange the cost of Commodity delivery from the Customer to the Representative Party and from the Representative Party to the Seller and as in the opposite directions, it is paid by the Customer.
    2. The Representative Party makes the decision of possibility of a return/exchange of Commodity, completely being guided by the decision of the Seller of possibility of a return/exchange.
    3. In case the Seller makes the decision of refusal to the Customer in a return/exchange, the Representative Party doesn't compensate the Customer the Commodity cost, and the decision of possibility of repeated Commodity return to the Customer is made by the Representative Party on an individual basis.
    4. All operations on a return/exchange are carried out in full accordance with conditions of the Seller, including, but without being limited to terms, procedure and the amount of compensation.
    5. The Customer has to consider Commodity delivery periods from the Customer to the Representative Party , terms of processing of a return/exchange to the warehouse of the Representative Party ( in advance of 5 working days) and Commodity delivery periods from the Representative Party to the Seller, at calculation of possibility of a return/exchange of Commodityto the Seller.
    6. Return of currencies to the Customer is carried out after full return of cost of Commodity by the Seller to the Representative Party. When opening debates and sealing marks on ebay.com and return of payment for the bought Commodity in online-shops the Representative Party has the right to hold the commission for the work and to return a balance to the Customer Account.
    7. The commission for services of the Representative Party doesn't come back, isn't dependent on the decision of the Seller on opportunity/impossibility of return of Commodity.
    8. At resending of the exchanged Commodity, the Customer pays an overall cost of processing of the order the Representative Party according to rates, specified at Shopozz.ru.
  9. Responsibility restrictions
    1. The Representative Party doesn't account for any expenses of the Customer or direct or indirect loss which can be put to the Customer when useing services of the Representative Party, caused to the Customer as a result of use or impossibility of use of Services and suffered as a result of mistakes, admissions, breaks in work, removals of files, changes of functions, defects, delays in work at data transmission, etc.
    2. The Representative Party doesn't account for actions of adjacent services and the services used for service to the Customer, but not belonging to the Representative Party: banks, post services, Internet service providers, e-mail-services, payment systems, etc.
    3. The Representative Party doesn't account for Commodity delivery periods from the Seller to the Representative Party.
    4. The Representative Party doesn't account for dates of answers from Sellers and reserves the right to contact the Seller 14 days later after Commodity purchase.
    5. The Representative Party doesn't account for quality and complete set of the goods received to the warehouse, and also doesn't provide with guarantee for Commodity acquired by the Customer by means of Services of the Representative Party.
    6. The Representative Party doesn't check the Commodity received from the Seller on compliance of the declared seller characteristics and in case of a mistake of the Seller, Representative Party doesn't account for discrepancy of Commodity. Check of Commodity is possible at additional expense, according to the rates specified at Shopozz.ru.
    7. The Representative Party doesn't account for dishonesty of the Sellers chosen by the Customer in cases: the Commodity is sent with a delay; the Commodity is sent, but does not correspond to the description; Commodity is not workering (though it is declared as working one); the Commodity is not sent (fraud cases).
    8. The Customer agrees not to make the Responsible Party the respondent or the codefendant in any obligations and the expenses connected with damage, put to the Customer as a result of action of the third parties, including, but without being limited to the Seller, Post and courier services, payment systems.
    9. Client accounts for correctness and completeness of the data specified in declaration and invoice, in case of invoice filling by the Customer or authorized representatives of the Responsible Party at the request of the Customer, issued in a profile.
    10. The performer doesn't account for the Customs duties during delivery a parcel and doesn't compensate them.
    11. The Responsible Party isn't the employee of transport company or post service and doesn't account for one of ways of transfer of Commodity.
    12. The Responsible Party pays for losses to the Customer according to his statement, and only in case the declared losses grew out in case of the mistakes made by employees of the Responsible Party. Thus the sum of compensation can't exceed the commission of the Responsible Party.
  10. Force majeure
    1. The parties are excused from partial or full non-execution of obligations under the present Agreement if this non-execution was a consequence of the force majeure circumstances which have arisen after conclusion of agreement as a result of events of extreme character which the participant couldn't neither expect, nor prevent by reasonable measures (force majeure). Such events of extreme character treat: flood, fire, earthquake, explosion, storm, epidemic and other natural phenomena, and also war or military operations, etc.
  11. Settlement of disputes
    1. In case of disagreements and the disputes connected to accomplishong of conditions of this Agreement the partis solve them by negotiations.
    2. In case of impossibility of the solution of disputes by negotiations, disputes are resolved in an order established by the legislation of the United States of America.
